MT Credit Builder Addendum to Lease Agreement

This MT Credit Builder Addendum ("Addendum") is made and entered into between the parties previously identified as Owner, by its agent ("Landlord"), and Resident listed below, on the date first indicated below. This Addendum is incorporated into the existing residential lease agreement ("Lease") between the parties and shall be considered an integral part thereof. Where the terms of this Addendum and the Lease conflict, the terms of this Addendum shall control.

Enrolled Resident Name:

By signing below Resident acknowledges those enrolled in MT Credit Builder program. Enrolled residents reflected above agrees to participate in the MT Credit Builder program and shall tender the amounts listed below as additional rent beginning on the first (1st) of the month following enrollment and activation of the service. Furthermore, Resident acknowledges and agrees the MT Credit Builder program may not be active at Resident’s property, and Mark-Taylor Residential Inc., makes no representations, warranties, or guarantees that the service will become active at Resident’s property during the term of the Lease or in the future.

Recitals

Landlord provides access to a service known as MT Credit Builder, which offers Residents credit building services designed to enhance the experience Residents have while residing at a Mark-Taylor Community. The MT Credit Builder service is provided by Union, not operated or controlled by Mark-Taylor or Owner. This service may be available as long as the property is managed by Mark-Taylor Residential Inc.

Agreement

  1. MT Credit Builder Enrollment.

    1.1. Upon opt-in and execution of this Addendum, Resident will be enrolled in MT Credit Builder provided by Union once the service becomes available.

    1.2. MT Credit Builder reports on-time rent payments. MT Credit Builder will not report late payments.

    1.3. Union, not Owner, may send the following Resident information to Experian, Equifax, and TransUnion (depending upon Union accreditation) once the service becomes available: 1) first name; 2) last name; 3) date of birth; 4) address; 5) city; 6) state; 7) zip; 8) Lease start date; 9) Lease duration; 10) Lease amount; 11) rental status; and 12) rental balance.

    1.4. On-time rent payments will be sent to all three (3) major credit bureaus Experian, Equifax, and TransUnion (depending upon Union accreditation), once the service becomes available.

    1.5. Existing Residents may opt-in to MT Credit Builder by following the instructions contained in an email provided by Union.

    1.6. Existing Residents have until the last day of each month to sign up for MT Credit Builder. Once the MT Credit Builder services becomes available and existing Residents are enrolled in MT Credit Builder, existing Residents shall be billed per month, per Resident participating in the program, as additional rent, beginning on the first (1st) of the month following opt-in. Once the MT Credit Builder service becomes available, on-time payments shall be reported on the month following opt-in.

  2. Opt-Out Option.

    2.1. Once the MT Credit Builder service becomes available, MT Credit Builder shall be provided to Resident on a month-to-month basis.


  1. 2.2. Residents in the middle of a Lease are not automatically enrolled and do not have to opt-out of MT Credit Builder, unless an existing Resident elects to enroll in MT Credit Builder.

    2.3. Existing Residents may opt-out at any time of the MT Credit Builder by logging into existing Resident’s MT Credit Builder account. Once in the MT Credit Builder account, existing Resident will navigate to the profile page and select cancel. After existing Resident selects cancel, a pop-up window will appear to confirm existing Resident’s decision to op-out of MT Credit Builder. Existing Resident shall select yes and submit. Existing Resident shall also send Management an email informing Management that existing Resident has elected to opt-out of MT Credit Builder.

    2.4. Once the MT Credit Builder service is operational, Resident's MT Credit Builder service shall start and continue monthly and Resident shall be billed per month until Resident opts-out of MT Credit Builder.

    2.5. If an opt-out request is received on or before the last day of the month, the MT Credit Builder service and billing shall end on the last day of the same month.

    2.6. In the event of termination there is no refund for services previously rendered.

  2. General Provisions.

    3.1. TO THE FULLEST EXTENT PERMITTED BY LAW MT CREDIT BUILDER IS PROVIDED ON AN “AS IS” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MARK-TAYLOR RESIDENTIAL, INC., MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND THAT RESIDENT’S CREDIT SCORE WILL BE IMPACTED, WHETHER POSITIVELY OR NEGATIVELY, BY USING THE MT CREDIT BUILDER SERVICE. RESIDENT EXPRESSLY ACKNOWLEDGES THAT A CREDIT SCORE IS BASED UPON NUMEROUS FACTORS INCLUDING, BUT NOT LIMITED TO, PAYMENT HISTORY.

    3.2. Questions regarding reports, credit, or technical support shall be directed to Union at support@gounion.com. General questions regarding billing may be directed to the Community email.

    3.3. In the event Mark-Taylor Residential Inc., no longer manages the property described in the Lease then this Addendum and the MT Credit Builder service shall automatically terminate. No refunds will be given for partial month’s service in the event of termination pursuant to this provision.

    3.4. Any modifications or amendments to this Addendum shall be made in writing and signed by both parties.

    3.5. Except as modified herein, all other terms and conditions of the Lease shall remain in full force and effect.
