MT+ Addendum

This MT+ Addendum (hereinafter the “Addendum”) is hereby entered into by and between the parties previously identified as Management and Resident on the date first indicated below. Where the terms of the Lease and this Addendum may conflict, the terms of this Addendum shall control.

Recitals
  1. Management offers a package known as MT+ which offers to its residents various services and community features designed to enhance the experience residents have while residing at a Mark-Taylor Community.
Agreement

Management agrees to provide, on a paid subscription basis pursuant to paragraph 5 infra, the following services:

  1. Gigablast (1GB) WiFi from Cox Communications: Gigablast WiFi provides you Cox’s highest quality internet available, with connectivity that is up to 50 times faster than average WiFi speeds. Each home will be equipped with a WiFi router to utilize Cox’s internet services. The router is not the property of Resident. Resident is responsible for any costs associated with the replacement of repair of the router in the event it is damaged, destroyed, or otherwise damages (normal wear and tear excluded). Resident agrees to allow access to the leased premises to any authorized service technician for Cox Communications for the purpose of maintaining the router and/or internet service connection.
  2. Smart Home Technology from iApartments: Smart Home Technology is a set of electronic devices that enable secure remote access and control by only you, the resident. These smart devices include an all-in-one smart hub thermostat, (1) plug, lock and (4) water sensors that you can use and monitor from anywhere, at any time. (Please see MT+ Frequently Asked Questions for additional information). The following terms control concerning the installation and maintenance of the Smart Home Technology:

    1. Third Party Installer. It is agreed in this Addendum that Management and Owner may utilize the services of iApartments and Cox Communications for the procurement, installation, and maintenance of technology upgrades in the leased premises needed to provide the Smart Home Equipment. It is agreed that Owner and Management shall have sole decision-making authority as to whom to contract with and that any change in vendor may be done by Management and/or Owner at any time.
    2. Equipment Damage. Resident is responsible to notify Management or Owner within 30 days of occupying the leased premises of any faulty or damaged Smart Home Equipment. Resident will be responsible for reimbursing the Owner for replacement costs of any damage incurred to the Smart Home Equipment beyond that of normal wear-and-tear during the occupancy of the leased premises.
  3. Valet Living Services: Valet Living Services provides you a variety of cleaning and convenience services, right from your home, including trash removal and options for house cleaning, pet-sitting, and plant care. These services are a la carte, please see the price schedule for these options.
  4. Fetch Package Services. Mark-Taylor Residential, Inc. has partnered with Fetch Package, Inc. to provide on-demand package delivery services. To utilize the Fetch service residents must create a profile at www.fetchpackage.com and send all packages to the Fetch warehouse address provided upon sign-up. Residents must comply with the Resident Terms & Conditions to utilize the Package Management Services. The leasing office will not accept packages on your behalf. Mark-Taylor Residential, Inc. is not responsible for any packages lost, destroyed, or damaged through Resident’s use of the services provide by Fetch Package, Inc.
  1. Monthly Subscription Cost. The cost for the MT+ Package shall be per month. The parties agree that this pricing is only available to the Community given the commitment of the community to these providers. As such, it is agreed that the subscription cost shall be due and owing regardless of whether or not Resident elects to participate in the MT+ Package.

    The costs associated with the MT+ Package will be due and owing as additional rent. Changes to the subscription may be made only at lease renewal. No modification of the subscription can be made that lessens services offered during the lease term.

  2. Release of Information. As part of the service packages listed above under the MT+ Package, the installation and maintenance of certain pieces of technology requires communication with third party vendors. By electing to participate in the MT+ Package, Resident is agreeing to the release of the following personal information solely to set up and maintain services provided under the MT+ Package: (1) Resident’s Full Name, (2) Resident’s email address, (3) Resident’s phone number, and (4) Resident’s unit number. If Resident does not consent to the disclosure of this information Resident must withdraw consent to personal release of information by signing the Privacy withdrawal provision on paragraph 7.
  3. Privacy Withdrawal. The use of the services available under the MT+ Package are voluntary. Resident may choose to not utilize some or all of these services by signing below. By not utilizing some of these services Resident is acknowledging that it will not be able to use the equipment and services provided under the MT+ Package and that the subscription cost, pursuant to paragraph 5, will remain collectible and due and owing monthly as additional rent.

    1. By signing below I am agreeing to not utilize all or some of the services covered in the MT+ Package and am agreeing that I will not be entitled to elected services offered under the MT+ Package and further agree to accept, as additional rent, the subscription fee outlined in paragraph 5 above.
