Resort Facilities Access Addendum

In consideration of the execution or renewal of a lease of the dwelling unit identified in the lease, Owner and Resident agree as follows:

Owner has entered into a Resort Facilities Access Agreement with the owner of the Arizona Grand Resort. This Agreement gives to Owner the right to grant residents of the San Paseo community access to certain of the amenities of the Arizona Grand Resort. Some of the amenities may be accessed free of charge; others will require the payment of appropriate remuneration directly to Arizona Grand Resort.

The amenities to which Resident has access are as follows:

1. 1. Golf: Resident may purchase a round of golf for no more than one foursome per day on a space-available basis with a reservation made no more than twenty-four (24) hours in advance. The round will be sold at a discount of 20.0% from the then-posted or then-published rate.
2. 2. Fitness Center: Resident may use the Fitness Center without charge at any time it is open to guests of the Resort. However, individuals under the age of 16 must be accompanied by an adult; and individuals under the age of 16 are not permitted to use the equipment. All those using the Fitness Center do so at their own risk.
3. 3. Spa and Salon: Resident may purchase spa and salon services at a discount of 10.0% from the rates charged by Arizona Grand Resort to its guests.
4. 4. Restaurants: Resident may enjoy the restaurants provided at the Arizona Grand Resort for groups of not more than 10 at a discount of 10.0% from the rates charged by Arizona Grand Resort to its guests. Note that Rustler's Rooste is not operated by the Resort.

Terms and Conditions of Use:

1. 1. Resident Card: Owner shall provide each Resident with a Resident Card. This card must be presented to Arizona Grand Resort at any time Resident utilizes any of the above-referenced amenities. Failure to produce the card upon request shall cause Resident to be denied the use of the amenities and/or services requested. The replacement cost for a Resident Card shall be $50.00.
2. 2. Payment for Use: Payment for the use of any of the amenities, excluding the Fitness Center, shall be payable to Arizona Grand Resort at the time the services or the amenities are made available to Resident.
3. 3. Discontinuation of Amenities: Resident acknowledges that the Resort has neither liability nor obligation to Resident (or to Owner), and that neither Resident nor Owner have any interest in the Resort. The Resort may discontinue or suspend any of the amenities referenced above and that such discontinuation or suspension will not give rise to claims against either the Owner or the Resort for the loss of use of the amenities or services.
4. 4. Revocation of Use: The Resident acknowledges that the Arizona Grand Resort may revoke the Resort Facilities Access Agreement at any time, especially for misconduct caused by the residents of this community. As a result, Owner may revoke Resident's access to the Resort amenities for any breach of the rules and regulation of the Resort and the same may be deemed by Owner to constitute a material breach of the lease.
5. 5. Hold Harmless and Indemnification: Resident agrees to assume any and all risks associated with the use of the amenities and shall indemnify and hold Owner harmless from any and all claims, losses, demands, or other liability whatsoever, for any damages or injury, however suffered by or occurring to any person, including, without limitation, guests at the community, which arise or are caused by any act of commission or omission of the Resident, Resident's occupants, family, guest, invitees or pets while using the amenities referenced above.

This LEASE ADDENDUM is incorporated into the lease, executed or renewed, this day between Owner and Resident.
